These Terms of Service ("Terms") govern your use of the CrowdTagg platform ("Service") operated by CrowdTagg Inc. ("CrowdTagg", "we", "us"). By using the Service you agree to these Terms. If you do not agree, do not use the Service.
You must be at least 18 years old to use CrowdTagg. By using the Service you represent and warrant that you are at least 18 and have the legal capacity to enter into these Terms.
CrowdTagg provides a face-matching platform that helps event attendees find photographs of themselves taken at events. The platform is made available to attendees free of charge. Optional print-on-demand purchases are available at stated prices. Event organizers use a separate organizer dashboard governed by additional terms.
By uploading a selfie you grant CrowdTagg a limited, one-time license to process the image solely to identify matching event photographs. You represent that the selfie depicts you (or a person for whom you have authority to act). The image and any derived faceprint are deleted immediately after matching — no license extends beyond that instant. See our Biometric Data Notice.
Photographs taken at events are owned by the respective photographer or event organizer. CrowdTagg is licensed by the organizer to display and deliver these photographs to identified attendees. Downloading a photo grants you a personal, non-commercial license for personal use only. You may not redistribute, sell, or commercially exploit event photos without written permission from the photographer/organizer.
Print orders are fulfilled by third-party print partners. Prices are displayed at checkout. All sales are final after production begins. Contact us within 48 hours of ordering for errors or quality issues. Shipping times are estimates only. CrowdTagg is not liable for carrier delays.
Payments are processed by Stripe, Inc. under Stripe's terms of service. CrowdTagg does not store payment card details. Disputed charges must be raised within 60 days of the transaction date.
You agree not to: (a) upload a selfie depicting any person other than yourself unless you have explicit authority; (b) attempt to identify or track other event attendees; (c) reverse engineer, scrape, or systematically access the Service; (d) upload images that are obscene, unlawful, or infringe third-party rights; (e) circumvent security or access controls; or (f) use the Service in any way that violates applicable law.
The CrowdTagg platform, including its software, design, and branding, is owned by CrowdTagg Inc. and protected by copyright and other laws. These Terms do not transfer any intellectual property rights to you.
Your use of the Service is also governed by our Privacy Policy and Biometric Data Notice, incorporated herein by reference.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT FACE-MATCHING WILL BE ACCURATE OR COMPLETE. EVENT PHOTO AVAILABILITY DEPENDS ON THE ORGANIZER.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CROWDTAGG'S TOTAL LIABILITY ARISING OUT OF OR RELATED TO THESE TERMS SHALL NOT EXCEED $100 USD OR THE AMOUNT YOU PAID TO CROWDTAGG IN THE 12 MONTHS PRECEDING THE CLAIM, WHICHEVER IS GREATER. IN NO EVENT SHALL CROWDTAGG BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.
You agree to indemnify and hold harmless CrowdTagg, its officers, directors, employees, and agents from any claim, demand, loss, or expense (including reasonable attorneys' fees) arising out of your use of the Service, your violation of these Terms, or your violation of any third-party right.
These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-law principles. Any dispute arising from these Terms shall be resolved by binding arbitration under the JAMS Streamlined Arbitration Rules, except that either party may seek injunctive relief in a court of competent jurisdiction. You waive the right to participate in a class action.
We may update these Terms from time to time. We will post the updated Terms and revise the effective date. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.
